Event Tickets,LLC / Ticketsmyway.com User Agreement
1. How this agreement works:
This User Agreement lists the terms of the agreement between you and Event Tickets,LLC. for the selling of tickets. By signing the registration form, you agree to accept the terms and conditions of this Agreement and to become a registered user of this Site. You may only use the Services if you are able to form legally binding contracts, and are over the age of 18.
2. Requirements:
2.1. You must own the tickets you are listing and they must not be stolen.
2.2. The tickets must be Hard Tickets (Not tickets obtained from an email attachment which are printed out such as Ticket Fast or E-Tickets.)
2.3. You warrant that your descriptions of the tickets accurately detail and describe the tickets offered for sale and that the tickets are valid and undamaged.
2.4. You must be provide us with a scan or fax of the actual tickets before we will list the tickets for sale.
2.5. You must have access to either email and a printer, or a fax machine for receiving the airbill for the completion of sale.
2.6. You must agree to bring the tickets to a FedEx shipping location after the tickets have been sold.
2.7. You must place a valid credit card on file for the case of verification or fraudulent tickets.
3. Privacy Policy:
We will not share your personal information, or any financial information with any third party.
4. Listing tickets as a Seller:
The Seller assigns a desired sell price to the tickets as well as a minimum sell price for the tickets and provides information such as the event description, date, section, row, and seat. If no minimum price is specified the minimum sell price will be assumed to be the same as the desired sell price.
5. Shipping of sellers tickets:
Once a purchase for the sellers tickets has been confirmed, Seller is responsible for fulfilling the order with the exact tickets that the Seller listed and shipping them via FedEx using the pre-paid shipping lable provided by Event Tickets,LLC. We will email or fax the airbill to you.
6. Notifying the Seller of the order:
Once we obtain an authorization from a Buyer, we notify the Seller of the sale via email and/or telephone that a Buyer has purchased the listed tickets and is willing to pay the agreed price as well as any shipping or handling charges that we have calculated for the ticket sale.
7. Payment:
Seller will can choose to receive either a check or be paid via Paypal. Event Tickets,LLC will submit payment to the seller once the tickets have been delivered to the buyer and we have verified the tickets to be as described. The seller will receive 80% of the listed amount for the tickets, and Event Tickets, LLC will retain 20% as the transaction fee. In most cases this entire process is completed within a week of the date of sale, however we encourage the seller to ship the tickets promptly as delays in shipment mean equal delays in the transfer of payment.
8. Permission.
As a Seller, you grant Event Tickets,LLC permission to charge your credit card if you fail to deliver the tickets you have listed, or if you deliver invalid, fraudulent, or misleading tickets. These charges may include the cost of replacement tickets, FedEx charges, or refunds to the Buyer.
9. Stolen Property:
The sale of stolen property on Ticketsmyway.com is strictly forbidden, and violates state, federal and international law. Event Tickets,LLC strongly supports law enforcement efforts to recover stolen property that is listed on the Site, and urges the prosecution of those responsible for knowingly attempting to sell such items on Ticketsmyway.com.
10. Investigations:
We may investigate complaints and violations of our policies. You agree to cooperate fully with such investigations, including without limitation, providing us specific information regarding your right to a ticket, the source of a ticket, your acquisition of a ticket, and the price you paid for a ticket.
11. Changes to listing:
7.1 Cancellations. If the tickets you have listed are no longer available, you must notify us immediately and must be prior to our receiving an order for those tickets. Valid notification consists of either verbal confirmation of the cancellation from one of our representatives or receiving an email confirmation. If you notify us of your cancellation solely vie email but have not yet received a reply with confirmation, the cancellation can not be considered as complete. You may request a confirmation email be sent to you if you have spoke with a representative.
11.2 Making Adjustments. Changes to any details of your listing such as quantity, section, row, seating, etc, can not be made to this agreement. In the event that you have discovered any previously disclosed information to be incorrect you must request and receive confirmation of the current agreement and must placed the updated listing within a new agreement form.
11.3 Sell price changes. Changes to the desired sell price or minimum sell price listed on an agreement require our receipt of a faxed signed statement from you requesting the change in list price.
12 Laws and Regulations:
You warrant that you will comply with all applicable local, state, federal and international laws, statutes and regulations regarding use of the Site and selling value of the tickets. Event Tickets,LLC does not monitor, obtain, nor have any knowledge of the face value of tickets listed on the Site.
13. Tax Indemnity:
You agree that Event Tickets,LLC is not responsible in any way for the accuracy or suitability of any payment of taxes to any entity on your behalf.
14. No Agency:
You and Event Tickets,LLC are independent contractors, and no agency, partnership, joint venture, employer-employee or franchisor-franchisee relationship is intended or created by this Agreement.
15 Notices:
Except as expressly stated otherwise, all notices to Event Tickets.lcc shall be sent to the email addresses, fax number, or mailing address provided on the Site.
